Data protection regulations of Elfenfunke

1 The security of user data comes first
Elfenfunke respects the privacy of all users of the website or online store (hereinafter referred to as "the customer" or "the customers"). These data protection regulations form the basis for the processing of personal data and provide information on what kind of user data is collected from customers by Elfenfunke, how Elfenfunke uses this data and what rights the customers are entitled to. Elfenfunke complies with the applicable data protection laws and processes the personal data solely for the purposes for which the data was transmitted.
This privacy policy will be adapted, supplemented or changed from time to time. With each new call or visit to the website, the current, retrievable version applies. If there are any inconsistencies between this Privacy Policy and the otherwise applicable contractual or business terms of Elfenfunke, the provisions of this Privacy Policy shall prevail.



2 Type and Purpose of Data Collected
The term "personal data" or "personal data" as used in this Privacy Policy includes information by which customers can be personally identified.
Processing of personal data means any handling of personal data, such as collecting, using, storing, disclosing, transmitting or deleting the data.
On the one hand, Elfenfunke collects personal data automatically when the customer interacts with the website or uses the online store. On the other hand, personal data is collected automatically or manually, which a customer provides (e.g. by contacting us, creating a user profile or customer account).


 

2.1 Data that is automatically collected when visiting the website of Elfenfunke, statistical visitor data is automatically collected about which parts of the web offer are visited by the customer. Each time a website is called up, the web server automatically saves a so-called server log file, which contains e.g. the name of the requested file, the IP address of the customer, date and time of the call, browser used, operating system, amount of data transferred and the requesting provider (access data) and documents the call. In this context, it is sometimes necessary to use so-called cookies (see section 4 below). ʉ۬This access data is evaluated exclusively for the purpose of ensuring trouble-free operation of the site and improving our services.

2.2 Data, in case of interaction with Elfenfunke, for contract processing, contacting and opening a customer account Elfenfunke does not automatically collect personal data of customers, such as name, address, telephone number or e-mail address.
On the other hand, personal data of customers are collected if a customer provides them voluntarily in the context of an order or when contacting Elfenfunke (e.g. via contact form or e-mail). Mandatory fields are marked as such, because in these cases Elfenfunke needs the data compellingly for the contract winding up, and/or for the treatment of the establishment of contact and without their indication the order and/or the establishment of contact cannot be dispatched. Which data is collected can be seen in the respective input forms.
If a customer decides to open a customer account, Elfenfunke uses the personal data for the purpose of opening the customer account. The mandatory information requested during registration must be provided in full, otherwise Elfenfunke may reject the registration. Elfenfunke uses the collected personal data only for the purpose of using the online store or the respective offer or service for which the customer has registered. In addition, Elfenfunke may use the customer's e-mail address to inform the customer about important changes, for example in the scope of the offer, or in case of technically necessary changes.
After complete execution of the contract or after deletion of the customer account, the customer's data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law, unless the customer has expressly consented to further use of the data or Elfenfunke reserves the right to use data beyond this, which is permitted by law. The deletion of the customer account is possible at any time and can be done either by sending a message to the contact details given below (cf. section 9 below) or by using a function provided for this purpose in the customer account.



3 Legal basis for the collection and processing of personal data
The legal basis for the collection and processing of the customer's personal data depends in each individual case on the purpose of the data processing. In particular, the following are possible
the protection of Elfenfunke's legitimate interests, provided that the Customer's interests or fundamental rights or freedoms are not unreasonably affected; the conclusion or performance of a contract; or consent of the Customer at the time of the collection of the Personal Data. The Customer may revoke its consent at any time. For this purpose, the Customer may send a message to this effect to the contact details described below. The legality of the data processing already carried out remains unaffected by the revocation.



4 Use of cookies and use of data
4.1 Cookies
In order to continuously improve the web presence for the customers, Elfenfunke may use cookies. Cookies are small pieces of software information that are stored by web browsers (e.g. Google Chrome, Internet Explorer or Mozilla Firefox) on the customer's computer hard drive in order to facilitate the use of the website (e.g. language selection, shopping cart, etc.). Some of the cookies used by Elfenfunke are deleted after the end of the browser session, i.e. after closing the web browser (so-called session cookies). Other cookies remain on the end device and enable Elfenfunke to recognize the customer's web browser during the next visit (so-called persistent cookies). The duration of the storage can be taken from the overview in the cookie settings of the web browser. Most web browsers automatically accept such cookies, but web browsers can be configured not to accept or store cookies. However, if cookies are disabled, the functionality of the website may be limited. For details, please refer to the operating instructions or the help function of the web browser.



4.2 Use of Data
The anonymized data, which is recorded by means of cookies when the Elfenfunke website is called up, can be used for web analysis purposes, for optimizing the website and for measuring performance. Elfenfunke may use third-party providers for this purpose, some of which have their own data protection regulations over which Elfenfunke has no influence.
Elfenfunke uses functions of the following web analysis services: Google Analytics Provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Google evaluates the use of the website in order to compile reports on website activity and to provide Elfenfunke with other services relating to website activity and internet usage. The IP address transmitted by the customer's web browser as part of Google Analytics is not merged with other Google data.
The information generated by cookies about the use of the website is usually transmitted to a Google server in the USA and stored there. Google observes the data protection provisions of the "Swiss-U.S. Privacy Shield" agreement and has registered with the U.S. Department of Commerce for the "Swiss-U.S. Privacy Shield" (information on the Swiss-U.S. Privacy Shield can be found at https://www.privacyshield.gov/Swiss-US-Privacy-Shield-FAQs).

Google AdWords and Google Conversion Tracking provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.


Within the scope of Google AdWords, Elfenfunke uses the so-called conversion tracking. When the customer clicks on an ad placed by Google, a cookie is set for conversion tracking. These cookies lose their validity after 30 days at the latest and do not serve to identify the customer. If the customer visits Elfenfunke's website and the cookie has not yet expired, Google and Elfenfunke can recognize that the customer clicked on the ad and was redirected to this page.
Elfenfunke learns from Google the total number of users who clicked on the ad and were redirected to a website tagged with a conversion tracking tag. However, Elfenfunke does not receive any information with which the customer can be personally identified.

Google Maps provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.


Elfenfunke uses Google Maps to visually display geographical information. When using Google Maps, Google transmits or processes data about the use of the Maps functions by website visitors, which may include in particular the IP address and location data. Elfenfunke has no influence on this data processing.
Insofar as information is transferred to Google servers in the USA and stored there, the American company Google LLC is certified under the "Swiss-U.S. Privacy Shield".
In order to deactivate the Google Maps service and thus prevent the transfer of data to Google, a customer must deactivate the Java Script function in the web browser. In this case, Google Maps cannot be used or can only be used to a limited extent.

4.3 Social-Media Content


Elfenfunke may use social media plugins from social networks, such as from Facebook, Instagram, Pinterest, TikTok or Twitter on the website.
When the customer calls up a website that contains such a plugin, the web browser establishes a direct connection to the servers of the respective social network. The content of the plugin is transmitted directly to the web browser by the respective provider and integrated into the page. By integrating the plugins, the providers receive the information that the customer's web browser has called up the corresponding Elfenfunke website, even if the customer does not have a profile with the corresponding social network or is not currently logged in. This information (including the IP address) is transmitted by the customer's web browser directly to a server of the respective provider (possibly to the USA) and stored there. If the customer is logged in to one of the services, the providers of the social network can directly assign the visit to the Elfenfunke website to the profile in the respective social network. If the customer interacts with the plugins, for example by clicking the "Like" or the "Share" button, the corresponding information is also transmitted directly to a server of the providers and stored there. The information is also published on the social network and displayed there to the customer's contacts.
These social network platforms have their own data protection regulations over which Elfenfunke has no influence.

If the customer does not want any of these plugins to be loaded, it is recommended to log out of the corresponding social networks. Furthermore, various web browsers can be set or supplemented with add-ons (e.g. Facebook blocker) so that the social media plugins are not loaded.



5.1 Newsletter
If the Customer would like to receive a newsletter offered by Elfenfunke, Elfenfunke requires an e-mail address of the Customer and other information that allows the verification that the Customer is the owner of the specified e-mail address and agrees to receive the newsletter (so-called "double-opt-in" procedure). If the customer wishes to subscribe to a newsletter as a registered customer, he can give his consent to this at the time of registration or later via the registration function in the customer account. Elfenfunke uses the service Kartra for this purpose.
With the newsletter, the customer regularly receives recommendations and offers that might interest him. For this purpose, Elfenfunke collects and processes personal data concerning the customer's usage behavior on the website, orders placed with Elfenfunke, and how the customer uses the newsletter (e.g. whether the newsletter is opened or which web URL links are clicked on). Elfenfunke may evaluate this data for statistical purposes in order to better tailor the content of the newsletter to the customer's interests.
The processing of the personal data entered in the newsletter registration form is based on the customer's consent, which the customer can revoke at any time for the future. The revocation takes place either via the "unsubscribe" link in the newsletter, written notification by the customer to Elfenfunke at the address listed below or the unsubscribe in the customer account. Elfenfunke uses the collected personal data for the content design and the dispatch of the newsletter. It is not passed on to third parties for own (advertising) purposes.
Elfenfunke stores the personal data deposited by the Customer for the purpose of the newsletter subscription until the customer unsubscribes from the newsletter.

5.3. 6 Disclosure of your data
Elfenfunke will not disclose the personal data of customers to third parties. The exception to this is if the customer has agreed to the disclosure of the data to companies that are not affiliated with Elfenfunke or if Elfenfunke is obliged to do so by law, by the authorities or by a court of law. Furthermore, if service providers that support Elfenfunke in data processing, website administration or in any other way, as well as in the provision of the products and services requested by the customer, are involved (e.g. parcel or newsletter delivery service providers). These third parties are obliged to maintain the same level of security and data protection as Elfenfunke.



7 Data security
The transmission of data via the internet is unfortunately not absolutely secure. Elfenfunke cooperates with service providers and internet providers who take appropriate technical and organizational security precautions to protect the personal data of the customers. However, Elfenfunke cannot guarantee the security of the data transmitted by the customer. Any data transmission is therefore at the customer's own risk.



8 Your information and revocation rights
Of course, every customer is free to inform Elfenfunke at any time - for example in an e-mail - that the personal data should not be used for contacting in the future. Participation in the special services of the Elfenfunke website, such as the newsletter service, can also be revoked at any time. In addition, it is possible to obtain information on the processing of the data or to request a copy of the personal data collected via the Elfenfunke website.

10 Final Provisions
Should individual provisions or parts of these data protection provisions prove to be void or ineffective, this shall not affect the validity of the remaining data protection provisions.
